Supreme Court: At present, the Supreme Court has given relief to the Shinde faction on the name and symbol of Shiv Sena. A bench of Chief Justice DY Chandrachud, Justice PS Narasimha and Justice JB Pardiwala did not stay the Election Commission’s decision on Wednesday. The court directed both the parties to file replies on the petition of the Uddhav faction. Both have to present their case before the court in two weeks.
Shinde faction proved itself before the Election Commission
In fact, the Uddhav faction has filed a petition in the Supreme Court against handing over the name and symbol of the Shiv Sena to the Shinde faction. During the hearing, the court said that the Shinde faction has proved itself before the Election Commission. At present, the order of the commission cannot be stayed. Further, the court said that the Uddhav camp can continue to use the temporary name and election symbol it has got so far.

Uddhav group’s lawyer lodged protest like this
During the hearing, the petitioner’s counsel Kapil Sibal told the court that the party’s offices and bank accounts were being taken over by the Shinde group. In such a situation, the court should order to maintain the status quo. He said that the Election Commission is saying that the 2018 constitution of Shiv Sena is not on record. That’s why the legislature will hear according to the majority in the party. This is wrong. If this is also the basis, then we have majority in the Legislative Council and Rajya Sabha. He was neglected.
Shinde’s lawyer gave this argument in the court
Shinde faction’s lawyer Neeraj Kishan Kaul said in the court that we had filed a caveat in the Supreme Court before Uddhav’s petition. In which it was said that the Supreme Court must hear our side before giving any decision. He said that the hearing against the decision of the Election Commission should be held in the High Court. They should not be allowed to speak directly in the Supreme Court.
