Rahul Gandhi Defamation Case: Gujarat BJP MLA Purnesh Modi on Tuesday filed a 30-page objection in response to Congress leader Rahul Gandhi’s petition. He has filed his objection in duplicate. One copy is given to the court and the other to the other party.
On the complaint of Purnesh Modi, Rahul Gandhi was sentenced to two years by Surat’s sessions court in a defamation case on the statement containing Modi surname. After that he was disqualified from the post of parliament. After this, Rahul Gandhi appealed against the conviction.
There will be a debate in the court on April 13
MLA Purnesh Modi’s lawyer Ketan Reshamwala told that the MLA appeared in the court of Additional Sessions Judge RP Mogera. He filed a 30-page objection to the petition to stay the conviction of the former Congress president. He said the matter would be argued on April 13, the same day Gandhi’s plea for stay of execution is to be heard in the sessions court.
The lawyer said that both the parties will present their respective arguments in the court on Thursday. He said Gandhi’s appeal against the trial court’s conviction order would remain pending before the sessions court and would be heard later.
Surat court gave two years sentence to Rahul Gandhi
A Surat court had on March 23 sentenced Rahul Gandhi to two years in jail in a 2019 defamation case on the complaint of MLA Purnesh Modi. Rahul Gandhi made a comment using the Modi surname at a meeting in Kolar, Karnataka. Taking a dig at Prime Minister Narendra Modi, Rahul said, “How come all thieves have Modi as their surname?” Rahul Gandhi has appealed against this decision in the court of the Sessions Judge. He has got bail. The hearing is to be held on April 13.
Membership was done according to the decision of the Supreme Court of 2013
As per a Supreme Court ruling in 2013, Rahul was disqualified as an MP on 24 March. Under the ruling, any MP or MLA convicted and sentenced to two years or more is automatically disqualified.
